Have you ever noticed a discrepancy in the way sales tax is levied on certain items in CA ?
A subway franchise that I go to in SF doesnt charge any sales tax on a sub. However when I went to a subway in Fremont, they did charge me a sales tax. In this case, looks like the sales tax policy was left to each franchisee. I also recently realized that Walgreens does not charge sales tax on choclates. I’m not sure whether this is Walgreens policy or the specific store policy. But I dont think that I have seen an exemption on choclates in other stores.
Have you ever seen an exemption from sales tax on other items in specific stores ?

Local sales taxes differs based on city.
Hmm….just to be clear, the emphasis was on no sales tax at all, not on local sales taxes.
The subway is supposed to charge sales tax. I am guessing that the subway guy is pocketing the money (without paying tax or showing it on the books) Did you pay cash for that? What if you pay by cc? Does he still charges notax? Taxing to not upto the Franchise.
BTW, food items from stores, etc are not charged sales tax in CA. However since Restuarants are providing a food service, they are suposed to charge tax on it.
Nice explanation Bhavesh.
